This Privacy Policy explains how Pyxels ("Pyxels", "we", "us", or "our") collects, uses, and protects your personal information when you use our website (pyxels.ai), our application (app.pyxels.ai), and related services (collectively, the "Service").

Pyxels is a Creative AI platform that allows users to generate images and videos using a curated selection of third-party AI models. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy.

Notice to International Users: Pyxels operates globally. If you are located in the European Economic Area, United Kingdom, Switzerland, or California, please see the dedicated sections below for additional rights that apply to you.

1. Information We Collect

1.1 Information You Provide

When you create an account or use the Service, we collect:

  • Account information: email address, password (encrypted), display name, profile picture (if provided).
  • Payment information: when you subscribe to a paid plan, our payment processor (Stripe) collects your payment details. Pyxels does not store full credit card numbers on its own servers.
  • Content you create: text prompts, reference images you upload, and the AI-generated images and videos you produce.
  • Support communications: when you contact us, we keep a record of your messages and our replies.

1.2 Information from Third-Party Sign-In Providers

When you choose to sign up or log in using a third-party authentication provider (such as Google or Apple), we receive certain profile information from that provider. The specific information received depends on the provider and your privacy settings, but typically includes:

  • Google Sign-In: your name, email address, profile picture, and unique Google account identifier.
  • Apple Sign-In: your name (if you choose to share it), email address (which may be a private relay email provided by Apple), and unique Apple account identifier.

We use this information solely to create and authenticate your account. We do not receive your password, contacts, files, or any other data from these providers beyond what is necessary for sign-in. We do not post to your social accounts or access any of your other data on those platforms.

You can revoke our access at any time through your Google account settings or Apple ID settings.

1.3 Information Collected Automatically

  • Usage data: features you access, models you use, credits consumed, generation history, session duration.
  • Device and technical data: IP address, browser type and version, operating system, device identifiers, referring URLs, and timestamps.
  • Cookies and similar technologies: we use cookies for authentication (HttpOnly session cookies), preferences, and analytics. You can control cookies through your browser settings.
  • Error and performance data: we use Sentry to capture errors and performance traces that help us diagnose issues. This may include limited contextual data about your session.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service;
  • Process your prompts and reference images through the AI models you select;
  • Manage your account, credits, subscriptions, and billing through Stripe;
  • Store your generated content so you can access it across sessions and devices;
  • Send transactional emails (account, billing, support);
  • Send product updates and marketing emails (you can unsubscribe at any time);
  • Detect, prevent, and respond to fraud, abuse, security incidents, and violations of our Terms of Service;
  • Improve the Service, debug issues, and analyze usage patterns;
  • Comply with legal obligations.

3. AI Model Processing — What Happens to Your Prompts and Content

Important: Pyxels does not train AI models on your content. We do not own, operate, or train any of the AI models available on our platform. We integrate with third-party AI providers and route your requests to them on your behalf.

When you generate an image or video on Pyxels, your prompt and any reference images you upload are transmitted to the third-party AI provider that hosts the model you selected. The provider processes your input, generates the output, and returns it to Pyxels, which then stores it in your account and displays it to you.

Each AI provider operates under its own privacy policy and data retention practices that govern what they do with prompts and outputs routed through their infrastructure. The specific providers powering each model may change over time as we evaluate quality, performance, and pricing. You acknowledge that by using the Service, your inputs and outputs may be processed by such providers.

4. Categories of Third Parties

To operate the Service, we may share your personal information with the following categories of parties, and as otherwise described in this Privacy Policy or at the time of collection:

  • Service providers. Third parties that provide services on our behalf or help us operate the Service and our business, including hosting and serverless compute, database and authentication infrastructure, object storage for generated content, error monitoring and performance tracing, and email delivery (both transactional and marketing).
  • AI model providers. Third-party providers of artificial intelligence models and inference infrastructure used to generate images, videos, and other outputs, as described in Section 3.
  • Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by the relevant app store or by our third-party payment processors, who may use your payment data in accordance with their own privacy policies.
  • Third parties designated by you. Third parties with whom you have instructed us to share your information or to whom you have otherwise provided your consent to share.
  • Authorities and others. Law enforcement, government authorities, and private parties, where we believe in good faith that disclosure is necessary or appropriate to comply with applicable law, respond to valid legal requests, enforce our Terms of Service, or protect the rights, property, or safety of Pyxels, our users, or others.
  • Business transferees. Third parties in connection with any actual or prospective merger, acquisition, financing, sale or transfer of assets, or similar transaction, including prospective counterparties and their advisors. Any acquirer, successor, or assignee will be bound by terms at least as protective as those in this policy.

5. Data Retention

  • Account data: retained for the duration of your account, plus a reasonable period afterward for legal, accounting, and fraud-prevention purposes.
  • Generated content: stored in your account until you delete it or close your account. We may retain backups for a limited period after deletion.
  • Prompts and reference images: retained alongside the generations they produced.
  • Logs and usage data: typically retained for 12 months unless needed longer for security or legal purposes.
  • Billing and tax records: retained for the period required by applicable tax and accounting law (typically 5–10 years).

6. Account Deletion

You can delete your Pyxels account at any time directly from your account settings page. When you delete your account:

  • Your profile information, generation history, prompts, and uploaded reference images are removed from our active systems;
  • Your generated content stored in our object storage is queued for deletion;
  • Active subscriptions are cancelled automatically (no further charges will be made);
  • Backups containing residual data are purged within a reasonable retention window;
  • Certain information may be retained where required by law (for example, billing records for tax purposes) or where necessary to prevent fraud, resolve disputes, or enforce our Terms of Service.

Deletion is permanent and cannot be undone. If you only want to pause your usage without losing your data, simply cancel your subscription from the billing settings instead.

7. Data Security

We take the security of your information seriously and use industry-standard measures to protect it, both in transit and at rest. We maintain appropriate technical and organizational safeguards designed to protect your data against unauthorized access, disclosure, alteration, or destruction, and we review and update our security practices on an ongoing basis.

However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential and for any activity that occurs under your account.

8. Your Rights

Regardless of where you live, you have the following rights with respect to your personal information:

  • Access: request a copy of the personal information we hold about you;
  • Correction: ask us to correct inaccurate or incomplete information;
  • Deletion: delete your account at any time via your settings (see Section 6), or request deletion of specific information by email;
  • Export: receive your information in a portable format;
  • Withdraw consent: withdraw any consent you previously provided;
  • Opt-out of marketing: unsubscribe from marketing emails at any time using the link in the email or by contacting us.

9. Notice to European Users (GDPR)

If you are located in the European Economic Area, United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) and equivalent national laws apply to our processing of your personal information.

9.1 Legal Bases for Processing

  • Performance of a contract: to provide the Service you signed up for.
  • Legitimate interests: to operate, secure, and improve the Service, prevent fraud, and communicate with you.
  • Consent: for marketing communications and certain cookies; you can withdraw consent at any time.
  • Legal obligation: to comply with tax, accounting, and other applicable laws.

9.2 Additional Rights

In addition to the rights in Section 8, you have the right to:

  • Object to processing based on legitimate interests;
  • Request restriction of processing;
  • Lodge a complaint with your local data protection authority.

9.3 International Data Transfers

Your personal information may be transferred to and processed in countries outside the European Economic Area, including the United States. Where required, we rely on Standard Contractual Clauses approved by the European Commission to ensure appropriate safeguards for these transfers.

10. Notice to California Residents (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you additional rights:

  • The right to know what personal information we collect, use, disclose, and sell or share;
  • The right to delete personal information;
  • The right to correct inaccurate personal information;
  • The right to opt out of the sale or sharing of personal information;
  • The right to limit the use of sensitive personal information;
  • The right to non-discrimination for exercising your rights.

Pyxels does not sell your personal information and does not share it for cross-context behavioral advertising.

11. Notice to Brazilian Users (LGPD)

If you are located in Brazil, the Lei Geral de Proteção de Dados (Law No. 13.709/2018, "LGPD") applies to our processing of your personal information. The rights described in Section 8 of this policy align with Article 18 of the LGPD, including the right to access, correct, delete, port, and request information about how your data is shared.

You may also contact the National Data Protection Authority (ANPD) if you believe your rights have been violated.

12. Children

The Service is not intended for anyone under 18 years of age. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, contact support@pyxels.ai and we will take appropriate steps to delete the information.

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Service and update the "Last Updated" date above. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised policy.
